The general terms that apply when using this website or working with Byte Size Studio.

Individual projects may also have their own proposal, quotation or agreement setting out the specific scope, price and deliverables.

About these terms

These Terms & Conditions apply to the Byte Size Studio website and provide general terms relating to services offered by Byte Size Studio.

By using this website, you agree to use it lawfully and in accordance with these terms.

Where you commission work from Byte Size Studio, the specific terms of your project may also be set out in a quotation, proposal, invoice, project brief or separate written agreement.

If project-specific written terms conflict with these general terms, the project-specific terms will take priority for that project.

Services

Byte Size Studio provides creative and digital services including:

  • website design and development;
  • website redesigns;
  • ecommerce and booking functionality;
  • website maintenance and support where agreed;
  • logo and brand design;
  • digital graphic design; and
  • print and promotional design.

The exact services included in a project will be agreed before work begins.

Quotes, pricing and project scope

Prices shown on the Byte Size Studio website are starting prices unless stated otherwise.

The final price of a project depends on the agreed requirements, complexity, number of pages, functionality, integrations, content, design requirements and time involved.

A quotation will normally be provided once enough information is available to establish the project scope.

Any work requested outside the agreed scope may be quoted and charged separately.

FROM PRICING

A website price marked "from" represents the starting price for the standard scope of that service. Additional or more complex requirements may increase the final quote.

Payments

Unless otherwise agreed in writing, website projects normally require:

  • 50% of the agreed project price before work begins; and
  • the remaining 50% before the completed website is launched or handed over.

Alternative payment arrangements may be agreed for larger projects or ongoing work.

Graphic design projects or smaller pieces of work may use different payment terms, which will be stated in the relevant quote or invoice.

Work may be paused where an agreed payment becomes overdue.

Client responsibilities

Clients are responsible for supplying information, feedback and materials needed to complete their project.

This may include:

  • written content;
  • photographs and imagery;
  • logos and brand assets;
  • product or service information;
  • prices;
  • account access where required;
  • legal or regulatory wording; and
  • timely feedback and approvals.

The client is responsible for ensuring they have permission to use any content, images, logos, fonts or other materials they provide.

Byte Size Studio is not responsible for copyright, licensing or legal issues arising from materials supplied by the client where the client did not have the necessary rights to use them.

Revisions and changes

The revisions included within a project will depend on the agreed scope or quotation.

Feedback should be provided clearly and, where possible, grouped together to avoid unnecessary repeated changes.

Significant changes to an approved design, major changes to the project direction or additional requirements introduced after work has started may be treated as additional work and quoted separately.

Project timelines

Any estimated completion date or project timeline is based on the scope and information available at the time.

Timelines may change where:

  • requested content is supplied late;
  • client feedback or approval is delayed;
  • the scope changes;
  • additional functionality is requested;
  • third-party services cause delays; or
  • circumstances outside reasonable control affect delivery.

Byte Size Studio will make reasonable efforts to communicate significant changes to an expected timeline.

Domains, hosting and third-party services

Projects may rely on third-party products or services such as domain registrars, hosting providers, payment providers, ecommerce platforms, booking systems, APIs, plugins or email services.

Unless expressly included within the agreed quote, fees charged by third-party services are the client's responsibility.

Where possible, client domains and third-party accounts should be registered in or transferred into the client's own name or account.

Byte Size Studio cannot guarantee that a third-party service will remain available, unchanged, compatible or free of interruption.

Changes, outages or pricing decisions made by third-party providers are outside Byte Size Studio's reasonable control.

Cancellation and paused projects

If a client wishes to cancel an active project, Byte Size Studio should be notified in writing as soon as possible.

Amounts already paid may be used towards work already completed, time already spent, committed third-party costs and other work carried out before cancellation.

Where completed work exceeds the amount already paid, an additional amount may be payable for work completed up to the date of cancellation.

Any project-specific cancellation or deposit terms provided in a proposal or agreement will take priority.

Projects that become inactive for an extended period because required content, feedback or communication has not been supplied may be paused and rescheduled.

Intellectual property and ownership

Unless otherwise agreed, final bespoke deliverables created specifically for the client will be released to the client once all amounts due for the project have been paid.

Byte Size Studio retains ownership of unfinished concepts, rejected concepts, working files, development tools, reusable code, general techniques, systems, templates and other pre-existing materials unless expressly agreed otherwise.

Third-party assets such as fonts, stock photography, software, libraries, plugins or platform components remain subject to their own licences and terms.

Clients must continue to comply with any applicable third-party licence after a project is handed over.

Portfolio and promotional use

Unless confidentiality has been agreed in writing, Byte Size Studio may display completed work for portfolio and promotional purposes.

This can include screenshots, mock-ups, project descriptions and links to publicly available completed work on the Byte Size Studio website, portfolio or social channels.

Confidential information or information that has not been made public by the client will not intentionally be disclosed as part of portfolio use.

Liability

Byte Size Studio will provide services with reasonable care and skill.

However, no website or digital system can be guaranteed to operate without interruption, bugs, security incidents or compatibility issues indefinitely.

Byte Size Studio is not responsible for losses caused solely by:

  • third-party platforms or service outages;
  • changes made by the client or another provider after handover;
  • inaccurate information supplied by the client;
  • use of the website contrary to advice or instructions;
  • failure by the client to maintain necessary subscriptions, domains, hosting or accounts; or
  • circumstances outside reasonable control.

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including any rights or liabilities that cannot legally be excluded.

Use of this website

Content on this website is provided for general information about Byte Size Studio, its services and previous work.

You must not knowingly:

  • misuse the website;
  • attempt to gain unauthorised access to the website or its infrastructure;
  • introduce malicious software or harmful code;
  • interfere with the operation or security of the website; or
  • copy or commercially reuse Byte Size Studio content without permission except where permitted by law.

Portfolio images, branding, copy, layouts and other original material displayed on this website remain protected by applicable intellectual property rights.

Governing law

These terms are governed by the laws of England and Wales.

Where legally permitted, disputes relating to these terms or services provided by Byte Size Studio will be subject to the jurisdiction of the courts of England and Wales.

Nothing in these terms removes statutory rights that apply and cannot lawfully be excluded or restricted.
